Have your efforts to have it amended essentially been ignored by ignorant and incompetent doctors?


Don't know who to claim in the county court against?

I recommend sending a formal pre-action letter asking for amendment under section 46 Data Protection Act 2018. They are allowed one calendar month to amend.

If they try saying it is a "record of a medical opinion" and therefore cannot be removed, ask them on what facts and evidence the medical opinion is based. When they can't provide any, tell them you can, because you're the only one who knows your own medical history.


Use MOD JSP 950 Medical Policy Leaflet 6-7-7 to give the criteria to assess yourself to product the facts of medical fitness. This gets changed about every year or two so you might have to do an FOI request to Whitehall for the latest version which takes a month.


Remember:

Recorded Verified History + Objective Criteria = Factually Justified Conclusion

Your verbal testimony is subjective evidence until verified.

In other words a medical assessment based on objective criteria is not an opinion, because the objective criteria can be applied by anyone to come to the same conclusion.


You only need to claim against MOD as legal data controller, ignore Capita or Serco who are technically just data processors.


They will try and use lawfare (expensive Barrister, probably one from Henderson Chambers) against you so be warned!


If you try sending it to the RAF, Army or Navy they will ignore it, bin it or send it somewhere where they will bin it.


MOD will most likely ignore you entirely. Then when you sue them they will get the person below involved.
